It is important for company personnel to know how to respond to a complaint of sexual harassment by conducting an investigation, or outsourcing an investigation.  Courts have found supervisor’s liable for acts of harassment and for not taking appropriate corrective action to eliminate existing harassment caused by others, and have ordered supervisors to pay damages to victims of harassment. 

 

In regards to your Employee Handbook, a company sexual harassment policy should not address the investigation process that will be followed in the event of a complaint as it is beyond the scope of an Employee Handbook.  Rather, it should address the company philosophy regarding sexual harassment, appropriate reporting method, and a statement that responds to confidentiality or retaliation concerns.
